CHAPTER 31

TRANSFER STATION

Now, therefore, the Town Board of the Town of Wilson does hereby ordain Chapter 31 of the Code of General Ordinances of the Town of Wilson as follows:

31.01 Town Use Only. The use of the Town Transfer Station shall be limited to the disposal of refuse produced, accumulated and collected within the limits of the Town of Wilson, unless specific contracts have been made in writing, in advance by the Town Board.

31.02 Non-Resident Dumping Prohibited. No person not a resident of the Town of Wilson or the representative of a resident of the Town of Wilson shall use the Town Transfer Station for the purposes of dumping refuse. No person shall dispose of refuse produced outside of or from the outside of the Town of Wilson in the Town Transfer Station.

31.03 Hours of Use. The Town Transfer Station shall be open for disposal operations as herein provided on such days and hours as the Town Board may hereinafter establish. The hours of permitted use shall be posted at the Transfer Station and thereupon be in full force and effect. Those hours being Tuesday and Saturday (excluding holidays) from 8:00 a.m. to 4:00 p.m.

31.04 Premises. The Town Transfer Station premises referred to in this chapter shall be those premises operated by the Town for disposal of items, other than those set forth in subsection 31.06, located at 4928 County Road A, Sheboygan, Wisconsin, 53081.

31.05 Trespassing Prohibited. No person without the consent of the Town of Wilson shall enter upon the Transfer Station premises during hours in which the Statioin is not in operation.

31.06 Disposal Limited. The following items, along with any other items which are prohibited from disposal by regulations of the State of Wisconsin, shall not be accepted or disposed of in the Transfer Station:

  1. Freezers and refrigerators;
  2. Batteries;
  3. Paint-related products, other than household paint;
  4. Fluorescent light bulbs;
  5. Household hazardous waste, including lawn and garden pesticides, acids and bases, poisons, aerosols, old gasoline, solvents, cleaners, thinners, and varnishes;
  6. Demolition materials from building, remodeling, renovation and razing projects;
  7. Refuse from commercial and/or industrial sites or operations;
  8. Mattresses, box springs, lounge chairs, overstuffed furniture, rugs and padding;
  9. Animal carcasses;
  10. Aluminum, plastic, metal or wood outdoor furniture;
  11. Toilets, sinks, tubs and washbasins;
  12. Tree stumps, unless absolutely clean.

31.07 Dumping on Public Streets. It shall be unlawful to dump or move onto any public street in the Town of Wilson any debris, refuse, or snow, at any time, or to place objects thereon, without specific permission from the Town Board. For purposes of this subsection, public street shall include any street, avenue, bridge, viaduct, underpass, overpass, and adjacent ditch in the Town, dedicated or devoted to public use.

31.08 Dumping on Private Property. In accordance with the laws of the State of Wisconsin Administrative Code, it is hereby declared to be unlawful to dump or store solid wastes upon private property unless said procedure is licensed by and done in accordance with the regulations of the Wisconsin Department of Natural Resources.

31.09 Penalty. Any person, firm or corporation violating this ordinance shall forfeit and pay for each offense (and each day that such nuisance shall continue shall be deemed a separate offense) a penalty of not less than one hundred dollars ($100.00), nor more than three hundred dollars ($300.00).

Effective Date. The herein Ordinance shall take effect upon enactment and publication.
