CHAPTER 66

NOISE

66.01 Prohibited Generally. Any unreasonably loud, disturbing and unnecessary noise or any noise of such character, intensity or duration as to be detrimental to the life or health of any individual or which disturbs the public peace and welfare is prohibited. The specific prohibitions enumerated in this chapter include loud, disturbing and unnecessary noise, but such enumeration shall not be deemed to be exclusive.

66.02 Construction Noise. The operation of construction equipment where such equipment can be heard within any residential area of the Town shall be prohibited between the hours of 7 p.m. and 7 a.m.

66.03 Horns and Signal Devices. The sounding of any horn or signal device on any automobile, motorcycle, bus or other vehicle while in motion, except as a danger signal, and the sounding of such device for an unnecessary and unreasonable period of time, are a violation of this chapter.

66.04 Stereos and Musical Instruments. The playing of any stereo, radio, or musical instrument in such a manner or with such volume as to annoy or disturb the quiet, comfort or repose of any person in the vicinity is a violation of this chapter.

66.05 Animals. The keeping of any animal which, by causing frequent or continued noise, shall disturb the comfort or repose of any person in the vicinity is in violation of this chapter.

66.06 Vehicles. The use of any automobile, motorcycle, bus or vehicle so out of repair, or so operated in such a manner as to create loud and unnecessary grating, grinding, rattling or other noise, is a violation of this chapter. The discharge into the open air of the exhaust of any vehicle, except through a muffler or other device which will effectively prevent loud or explosive noises therefrom, is a violation of this chapter. Squealing of automobile tires by intentional, sudden acceleration or deceleration shall also be prohibited.

66.07 Penalty. Each person or entity found to be in violation of any of the provisions of this chapter shall for each offense be punished by a forfeiture of not less than Fifty Dollars ($50.00) and not more than Two Hundred Dollars ($200.00), and in default of payment thereof imprisonment not to exceed Twenty (20) days for each violation.

Effective Date. The herein Ordinance shall take effect upon enactment and publication.
