CHAPTER 67

NOXIOUS WEEDS

67.01 Defined. The term "noxious weeds" as used in this chapter includes the following:

  1. Canada Thistle;
  2. Leafy Spurge;
  3. Field Bindweed (creeping Jenny);
  4. Any member of the genus Lythrum (purple loosestrife) or hybrids thereof;
  5. Multi-flora Rose;
  6. Any other perennial weed having a network of underground roots, rhizomes, stems, or other underground appendages that readily reproduce more plants of rank nature; and
  7. Any annual or biennial whose seed reproduces readily into tall or spreading plants that are undesirable in nature.

67.02 Prohibited. No person may plant, cultivate, sell, offer for sale, or distribute any noxious weeds or seeds thereof.

67.03 Destruction. Every person or entity who owns, occupies or controls land within the Town of Wilson shall be required to destroy all noxious weeds on such land.

67.04 Exception. This chapter shall not apply to land owned, occupied, or controlled by the Department of Natural Resources.

67.05 Penalty. Any person who knowingly violates this section shall forfeit not more than One Hundred Dollars ($100.00). Each violation of this section is a separate offense.

Effective Date. The herein Ordinance shall take effect upon enactment and publication.
