CHARGES FOR SERVICES
70.01 Statutory Reference. This chapter is enacted pursuant to sections 60.01, 60.22, 60.23, 60.62, 66.0627, 66.0701, and 66.0702, WI Statutes.
70.02 Charge for Service. Whenever the Town of Wilson or one of its commissions, boards, agencies, departments or officials provides a service, and a fee or charge for service has not been established by statute or ordinance, the Town Board may authorize a charge to the beneficiary of such service, provided that law does not prohibit such charge.
70.03 Notice and Hearing. Before a charge is authorized by the Board under the preceding section, the Clerk shall provide not less than ten (10) days advance notice by first class mail to the person (s) proposed to be charged. The notice shall include a description of the service, an estimate of the charges, and a statement that the person(s) to be charged have the right to appear before the Board and be heard before the charge is authorized by the Board.
70.04 Exception for Fire Departments. The fire departments operated by or contracting with the Town need not obtain advance authorization form the Board for charges for reimbursement of costs incurred in responding to fire calls that do not exceed $250.00 per call. In such cases, the fire departments may issue bills directly to the benefited or responsible party, provided that the bill includes notice that the recipient may request a hearing before the Board to object to the bill.
All ordinances and parts of ordinances in conflict herewith are hereby repealed.
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by reason of any decision of any court or competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence, clause or phrase or portion thereof.
Effective Date. The herein Ordinance shall take effect upon enactment and publication.
