CHAPTER 9 (October 2006)
OUTDOOR WOOD BURNING UNITS

Now, therefore, the Town Board of the Town of Wilson does hereby ordain Chapter 9 of the Code of General Ordinances of the Town of Wilson as follows:

For parcels within the Town of Wilson outdoor wood burning units are allowed with an approved permit. The permit must be obtained from the Town Office prior to the installation of the wood burning unit.

Inclusions: All outdoor wood burning furnaces/units.

Description: Includes an accessory structure or appliance designed for the location ordinarily outside the principal structure and used to transfer or provide heat via liquid or other means, by burning wood or other solid fuels, for heating any principal or accessory structure on the premises.

Exclusions: This does not include lawfully operated fire pits, barbeques, fryers, grills or chimneys.

Locations: No detached energy system shall be located in a front or street yard location.

Setbacks:

  1. Minimum setbacks to side and rear yards shall be 100’ feet minimum in agricultural districts;
  2. Minimum setback to an adjacent front yard or street residence shall be 100’ in agricultural districts;
  3. Minimum setback to any adjacent residential housing unit shall be 200’;
  4. Minimum setbacks to side and rear yards shall be 200’ fee minimum in residential districts;
  5. Minimum setbacks to an adjacent front yard or street residence shall be 200’ in residential districts;
  6. Minimum chimney stack height shall be 20’ unless the unit is located at least 350’ from all lot lines in all zoning districts, then a minimum chimney height can be as low as 12’, with a maximum chimney stack height of 30’.

Impacts: No outdoor wood/solid fuel burning furnace shall create an undesirable impact upon adjacent property or otherwise create a public nuisance. All outdoor furnaces are to meet emission standards currently required by the Environmental Protection Agency (EPA) and the Underwriters Laboratories (UL) listing. This documentation must be provided at the time the permit is applied for.

Building permit: A building permit is required for all outdoor wood burning units. The building permit application can be obtained at the Town Office with documentation regarding emission standards. Fees are determined by the Town Board.

Violations and Penalties. Any person who violates, disobeys, neglects, omits, or refuses to comply shall forfeit not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) for each offense, together with the costs of prosecution, and in default of payment of such forfeiture and costs of prosecution shall be imprisoned in the Sheboygan County Jail until said forfeiture and costs are paid, but not to exceed thirty (30) days for each violation.

Effective Date. The herein Ordinance shall take effect upon enactment and publication.
