CHAPTER 90

UNIFORM DWELLING CODE

90.01 Permits Required. This ordinance is adopted under the authority granted by Sec. 101.65, Wisconsin Statutes.

90.02 Purpose. The purpose of this ordinance is to promote the general health, safety and welfare and to maintain required local uniformity with the administrative and technical requirements of the Wisconsin Uniform Dwelling Code.

90.03 Uniform Dwelling Code Adopted. The Wisconsin Uniform Dwelling Code, Chs. Comm 20-25 of the Wisconsin Administrative Code, and all amendments thereto, is adopted and incorporated by reference and shall apply to the construction and inspection of all one- and two-family dwellings, alterations and additions thereto, and detached garages serving such dwellings.

90.04 Building Inspector. There is hereby created the position of Building Inspector, who shall administer and enforce this ordinance and shall be certified by the Division of Safety & Buildings, as specified by the Wisconsin Statutes, in the category of Uniform Dwelling Code Construction Inspector.

90.05 Building Permit Required. No person shall build, add on to, or alter any building within the scope of this ordinance without first obtaining a building permit for such work. Application for a building permit shall be made in writing upon forms issued by the Town. The Building Inspector shall issue all permits for new structures or projects in which the dimensional changes are made to an outside structure. The Town Clerk shall issue all building permits for other projects, except those covered by section 90.09.

90.06 Occupancy Permit. If the Building Inspector, after completing all required inspection, finds that a building has been constructed in accordance with the applicable codes, then the Inspector shall issue an occupancy permit. No person may have occupancy of a building until an occupancy permit is issued.

90.07 Plans. For all new structures or projects in which dimensional changes are made to outside structures, a complete set of plans and specifications shall be submitted to the Building Inspector, including a situation plan showing the location of the proposed building or addition with respect to adjoining streets, alleys, lot lines and buildings.

90.08 Building Permit Fee. The building permit fees shall be determined by resolution.

90.09 Time Limit. A building permit shall expire one year after its issuance, and may be renewed for one additional year upon such expiration.

90.10 Minor Repairs. Building permits shall not be required for repairs or minor alterations which do not change the occupancy, area, structural strength, fire protection, light or ventilation of a building, to a cost of up to Five Hundred Dollars ($500). Costs to include materials and labor.

90.11 Penalties. The enforcement of this section and all other laws and ordinances relating to building shall be by means of the withholding or revocation of building permits, imposition of forfeitures and injunctive action. Forfeitures shall not be less than Fifty Dollars ($50.00) nor more than One Thousand Dollars ($1000.00) for each day of noncompliance. In the event that a person or entity begins work covered by this chapter without first obtaining a permit as required in section 90.05, the building permit fee for that work shall be doubled."

Effective Date. The herein Ordinance shall take effect upon enactment and publication.
